Terms and Conditions

1. These terms of trade govern the sale and supply of goods by Foundry Miniatures Ltd and Foundry Miniatures Ltd may amend these terms from time to time as it deems fit to do so.

2. Orders placed will be treated as an offer to buy and Foundry Miniatures Ltd reserve the right to decline any order in the case of obvious errors or inaccuracies regarding the goods or for the goods being unavailable (see 3. below). Foundry Miniatures Ltd reserves the right to place restrictions on the volume of any goods ordered. Our model miniatures contain lead and are not suitable for use by persons under the age of fifteen THEY ARE NOT TOYS, by placing an order with Foundry Miniatures Ltd it is understood that the customer has declared knowledge of this fact and meets the minimum age requirement in respect of purchase and use.

3. The prices and availability of the goods are specified on the Foundry Miniatures Ltd website at www.foundryfantasy.com and such information is subject to change without notice. Customers should contact us to confirm the current price when ordering by post, phone or fax.

4. All our prices are displayed with our products on our website www.foundryfantasy.com in UK pounds, US dollars and Euros; the currency used for invoicing and payment will be determined by the country where the goods are requested to be delivered.

5. Import Taxes (outside the UK); Foundry Miniatures Ltd is not responsible for any charges the customer may have to pay in taxes or customs duty. We suggest customers contact their local customs office to establish what additional charges may be incurred on importation.

6. Foundry Miniatures Ltd will normally process orders within 24 hours of receipt but due to problems that may be encountered in the postal service customers may not receive the goods as fast as we would like. In nearly all cases customers receive the goods ordered within thirty days (beginning with the day after we accepted the offer to buy) at the delivery address supplied. Where the order consists of more than one package it is very normal for them to be delivered on different days. Title to the goods will pass on full payment for the goods and Foundry miniatures Ltd takes no responsibility for the goods once they have been delivered to the address specified.

7. We hope that all customers will be happy with their purchases from Foundry Miniatures Ltd; however if not there is a right to cancel the contract by sending to a notice of cancellation. We would appreciate it if customers would send any such notice in the form of a letter or fax, stating clearly their full name and address, any relevant details of the purchase (order number etc) and that they wish to cancel the contract to the following address: Foundry Miniatures Ltd, 24-34 St Marks Street, Nottingham NG3 1DE

The right to cancel the contract exists from the time of the purchase the goods until the expiry of seven working days beginning with the day after the day that the goods were delivered. Where any part of the cancelled contract refers to goods that can be inspected without removing the packaging (blister packs for example) these items will only be accepted for return and refund if they remain unopened. Foundry Miniatures Ltd reserves the right to request the return of any goods that are the subject of a cancellation order at the customers cost. Foundry Miniatures Ltd recommends that registered post or recorded delivery is used for returning goods. Foundry Miniatures Ltd will, within 30 days of receiving the notice of cancellation and the returned goods whichever is the later, reimburse without charge, any sum that has been paid for the goods.
Customers’ statutory rights are not affected.

8. Contracts between customers and Foundry Miniatures Ltd shall be governed by English Law and all disputes shall be submitted to the exclusive jurisdiction of the English courts.

9. If for any reason any part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected unless the substantive purpose of the contract is then frustrated.

10. As far as is permitted by law, Foundry Miniatures Ltd’s liability in respect of any claim arising in relation to the sale of goods shall not exceed the price paid for the goods in question.
